Terms of Service

These Terms of Service (“Terms”) govern access to and use of Workhorse Production Tools (“Workhorse,” “the Service”), operated by Fire Creative / BKN Films (“Fire Creative,” “we,” “us”). By creating an account or using Workhorse, you agree to these Terms. If you do not agree, do not use the Service.

1. What Workhorse Is

Workhorse is a production-management tool for film, television, and live-event productions. It helps you track paperwork and deadlines (permits, certificates of insurance, W-9s, deal memos, and similar documents), manage crew availability and bookings, run budgets and vendor lines, track sponsor deliverables, log show cues and run-of-show details, and manage production paperwork and reminders in one place. Workhorse uses an AI service to help read uploaded documents and voice input and pull out details like document type and key dates.

2. Accounts

You must be at least 18 years old and able to form a binding contract to use Workhorse. Workhorse is intended for business/professional use by production companies, producers, and their teams — not for personal consumer use. Sign-in is by email link (no password); you are responsible for keeping access to your email account secure, and for all activity that occurs under your account. Notify us promptly at the contact address below if you suspect unauthorized use.

3. Subscription Plans & Billing

Workhorse is offered on Pro and Studio subscription plans, billed monthly or yearly as shown on the Billing page. Payment is processed by Stripe; we never see or store your full card number. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand from the Billing page. You can cancel at any time; cancellation takes effect at the end of the current billing period, and access continues until then. Fees are non-refundable except where required by law or expressly stated otherwise. We may change plan pricing on a going-forward basis with reasonable notice.

4. Your Content

“Your Content” means the documents, crew and contact information, budgets, sponsor details, show cues, voice input, and other data you or your team upload or enter into Workhorse. You retain all ownership rights in Your Content. You grant Fire Creative a limited license to host, store, process, and display Your Content solely to operate and provide the Service to you (including sending it to our AI and infrastructure providers as described in the Privacy Policy). You are responsible for having the right to submit any third-party personal information (such as crew or sponsor contact details) that you enter into Workhorse, and for using it lawfully.

5. AI Features & Accuracy

Workhorse uses AI to extract information from uploaded documents (such as document type and key dates) and to interpret voice commands. AI output can be wrong or incomplete. Workhorse is a tracking aid, not a substitute for your own review — you are solely responsible for verifying dates, document types, and any other extracted or AI-generated information before relying on it, especially for compliance-critical items like insurance certificates, permits, or tax forms. We are not liable for missed deadlines or compliance failures resulting from inaccurate AI extraction or interpretation.

6. Optional Third-Party Integrations

Workhorse may optionally connect to third-party services such as monday.com or Zoom when configured. These integrations are provided for convenience, are subject to those providers’ own terms, and are offered “as is” — Fire Creative is not responsible for their availability or behavior.

7. Acceptable Use

You agree not to:

  • Use Workhorse for any unlawful purpose or in violation of any applicable law;
  • Upload content you don’t have the right to share, or that infringes another party’s rights;
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Reverse-engineer or resell the Service without our written permission.

8. Intellectual Property

Workhorse, its software, design, and branding are owned by Fire Creative and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as needed to use the Service normally.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.

10. Limitation of Liability

To the maximum extent permitted by law, Fire Creative will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

You may stop using Workhorse and cancel your subscription at any time from the Billing page. We may suspend or terminate your access if you materially breach these Terms, or as needed to protect the Service or other users. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including Sections 9, 10, and 13) will survive.

12. Changes to These Terms

We may update these Terms from time to time. If changes are material, we’ll make reasonable efforts to notify account holders (such as by email or an in-app notice). Continued use of Workhorse after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles, and any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.
